1. Who and what
Tier 2 Desk is a Jestr company (Duke Security, Inc., Delaware, USA) ("we") prepares Washington Clean Buildings Performance Standard Tier 2 compliance documents for the building owner or their authorized agent ("you") and project-manages them to submission. We are not an engineering firm and not affiliated with the Department of Commerce.
2. Prices and payment
The prices on /pricing on the day you start apply, per building, in US dollars, excluding any taxes. A $500 deposit starts the work; the balance is due when the package is ready to submit. We send an invoice for the balance.
3. Refunds
Cancel before we deliver the draft Energy Management Plan and O&M program and we refund the deposit in full. If Commerce rejects the application and we cannot fix it, we refund the balance. Refunds go to the original card within 10 business days of the request.
4. The Qualified Energy Manager
The QEM is an individual you designate. With the partner tier we propose one; they review the work independently and may decline to sign until issues are fixed. With your own QEM, signing and submission are your QEM's responsibility.
5. What you do
Provide accurate information, utility authorizations, equipment photos and access; create and control your own Secure Access Washington and portal accounts; sign Form A. Delays in data or signatures move our dates by the same amount.
6. No guarantees beyond the work
We don't guarantee the Early Adopter Incentive, Commerce's review time or outcome, or that rules won't change. The incentive is paid by your utility and can be partial or zero. Nothing here is legal advice.
7. Liability
Our total liability for a building is limited to the fees you paid us for that building. We aren't liable for indirect losses, including penalties caused by information you gave us that was wrong or late.
8. Law
